Level of implementation of the action: Unimplemented.Ombudsman’s Office, Dumitru Roman, e-mail d.roman@inst.ombudsman.md, tel. 022 234800 The action has not been implemented according to the timeframe, objective and outcome indicators due to the lack of financial resources for the 2013 budget year. Later, the Law on the Ombudsman was finalized and passed on 3 April 2014. It offers new solutions in the part related to the status and duties of the child’s ombudsman. In such a situation, according to the provisions of pt. 24/2 of the methodology for implementing the 2011-2016 JSRS, the Working Group proposed amending the timeframe for this action to Quarter I of 2016. Otherwise, in the current conditions, the implementation of this action would be formal, implying unjustified costs. Discussions are being held currently at national and international levels about the structure of an Ombudsman, and especially about whether a specialized Ombudsman (in Moldova – the Child’s Ombudsman) should be component part of the general Ombudsman.
The Ombudsman’s Office has set to conduct this study after one year of existence of the Child’s Ombudsman so that to assess the efficiency of its work against the provisions of the Law on the Ombudsman no.52 of 3 April 2014. Moreover, according to the Opinion of the Venice Commission on the Ombudsman Law, passed during the 103rd plenary reunion of 18-19 June 2015, "the provisions on the relation between the People’s Ombudsman and the Child’s Ombudsman seem to be unclear; it is not clear whether "People’s Ombudsman” means only People’s Ombudsman or also includes the Child’s Ombudsman; it would be important to bring more clarity in this sense” (Chapter II. International expertise (international expert) that would conduct the study based on the existing best practices in order to adopt a model of an efficient, functional and independent institution that would be able to cope with the specific challenges in the social context of the Republic Moldova.
